You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use only. This license does not include any resale or commercial use of the Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Service or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall FlirtynLocal, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to damages for loss of profits, loss of data, loss of goodwill, work stoppage, computer failure or malfunction, or any other commercial damages or losses, arising out of or in connection with your use, or inability to use, the Service, any websites linked to it, any content on the Service, or such other websites, even if advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you have paid to FlirtynLocal for the Service in the twelve (12) months prior to the event giving rise to the liability, or (b) one hundred U.S. dollars (USD $100).

This limitation of liability applies regardless of the legal theory on which the claim is based, including contract, tort (including negligence), strict liability, or any other basis.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FLIRTYNLOCAL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FLIRTYNLOCAL MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

No advice or information, whether oral or written, obtained by you from FlirtynLocal or through the Service shall create any warranty not expressly stated in these Terms.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings page.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the courts of the United Kingdom.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
